1. Agreement to Terms

By creating a MatchNest account or using our services, you enter into a binding agreement with MatchNest. These Terms of Service ("Terms") outline the rules, rights, and responsibilities that govern your use of our AI-powered dating platform.

These Terms work alongside our Privacy Policy, which explains how we collect, store, and protect your personal data. Together, these documents form the complete agreement between you and MatchNest. If you don't agree with any part of these Terms, please do not use our services.

2. Eligibility

MatchNest is designed for genuine people seeking meaningful connections. We have strict eligibility requirements to maintain a safe and authentic community.

2.1 Age Requirements

You must be at least 18 years old to use MatchNest. This age requirement exists because our platform involves romantic relationships and personal data sharing, which require legal adult status to consent to. We use age verification during account creation and may request additional verification if needed.

2.2 Capacity to Contract

By using MatchNest, you confirm that you have the legal ability to enter into a binding agreement. This means you're not restricted by law from using internet services or forming contracts. Users who are barred from using our services under applicable laws should not access MatchNest.

3. Account Registration

Your MatchNest account is your gateway to finding meaningful relationships. Keeping your account information accurate helps us provide you with the best possible matches.

3.1 Account Creation

When you create a MatchNest account, you agree to provide accurate, current, and complete information about yourself. This includes your name, date of birth, gender, photos, and other profile details. We use this information to match you with compatible people and to maintain the integrity of our community.

Multiple accounts per person are prohibited because they can be used to circumvent our safety features, spam other users, or engage in deceptive behavior. If we detect multiple accounts, we may suspend or terminate all related accounts.

3.2 Account Security

You're responsible for keeping your MatchNest account credentials (phone number, password) confidential. If someone else accesses your account, they can read your messages, see your private photos, and interact with matches using your identity. This could lead to embarrassment, blackmail, or other harms.

If you suspect unauthorized access to your account, please notify us immediately at [email protected]. You're liable for all activities that occur under your account, so taking security precautions is essential.

4. User Conduct & Prohibited Behavior

MatchNest strives to be a respectful, inclusive space where people can be authentic. We have clear expectations for behavior and zero tolerance for harmful conduct.

4.1 Prohibited Activities

The following behaviors undermine the safety and trust that our community deserves:

• Harassment: Any form of bullying, stalking, threatening, or intimidating behavior toward other users is strictly prohibited. This includes sending repeated unwanted messages, making derogatory comments, or using the platform to obsess over someone.
• Impersonation: Pretending to be someone else-including celebrities, public figures, or real people you don't know-is deceptive and harmful. Your profile must represent your authentic self.
• Spam: Sending unsolicited commercial messages, promotional content, or repetitive messages to multiple users clutters our platform and frustrates genuine connections.
• Scams: Any attempt to defraud other users-including romance scams, phishing, financial schemes, or catfishing-will result in immediate account termination and may be reported to law enforcement.
• Hate Speech: Content that promotes violence, discrimination, or hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics has no place on MatchNest.
• Nudity: Sharing explicit or sexually explicit content violates our community standards and can traumatize other users. This includes photos with exposed intimate areas.
• Illegal Activities: Using MatchNest to facilitate any illegal activity-including drug trafficking, prostitution, or human trafficking-is grounds for immediate termination and legal action.
• Minor Safety: Any content or behavior that endangers minors, including attempting to meet underage individuals, is absolutely prohibited and will be reported to authorities.

4.2 Impulsive Swipe Detection

MatchNest monitors swipe velocity to encourage thoughtful, genuine engagement. If you swipe through 5 profiles in under 20 seconds, the system will automatically apply a 5-minute reflection pause with a countdown timer. This feature is designed to improve connection quality - users who read profiles before swiping show a 2.4x higher match-to-conversation conversion rate (MatchNest internal data, 2025). Your recent swipe timestamps are stored temporarily to enable this feature. This is not a penalty but a product design feature aimed at promoting genuine interactions. The restriction lifts automatically once the cooldown expires.

4.3 Content Guidelines

When you submit content to MatchNest - photos, bios, answers to prompts, or messages - you retain ownership of that content. However, you grant us a license to use, store, and display it as needed to provide our services.

All content must be appropriate for a dating platform focused on genuine connections. We may remove content that violates these guidelines, violates applicable laws, or could harm other users. Repeated violations may result in account suspension or termination.

4.4 Automated Content Moderation

MatchNest uses automated AI tools to screen content before it reaches other users. By using the platform you acknowledge and agree to this screening.

What is scanned:

• Photos - every photo uploaded (during onboarding or profile editing) is scanned by Amazon Rekognition Content Moderation before being saved.
• Chat messages and letters - every message and every initial "letter" you send is scanned by Amazon Comprehend Toxic Content Detection before being delivered to the recipient.

4.5 Strike System & Automatic Bans

After each violation you will receive an in-app warning dialog showing the detected policy category (e.g. "HATE_SPEECH", "Explicit Nudity") and the number of strikes remaining before a ban. When a ban is triggered, your account is locked and you are logged out immediately.

4.6 Moderation Audit Trail

Every content violation is recorded in an immutable audit log containing the detected categories, AI confidence scores, a snippet of the flagged text (or the label names for photos), the strike count, the action taken, and a timestamp. These records are the basis for any appeal. They are retained for 3 years even after account deletion. Full details are in our Privacy Policy (Section 3.6).

4.7 Appeals

If you believe a moderation action was a false positive, email [email protected] with subject "Moderation Appeal" within 60 days of the action. Include your registered email address. We will:

• Retrieve the full moderation audit log for the incident (categories, confidence scores, content snippet)
• Manually review the AI result against our policy thresholds
• Share the detected categories and confidence scores with you
• Respond within 10 business days and reverse the action if confirmed as a false positive

We will not reverse bans that result from clear, high-confidence policy violations.

5. Payments & NestyPoints Token Economy

MatchNest is 100% free. There are no subscription plans. Every user - from day one - has access to unlimited swipes, unlimited matching, and full messaging at no cost. Revenue is generated through optional NestyPoints token purchases and voluntary ad-watching.

5.1 Free Core Features

The following features are permanently free for all users, with no subscription required and no daily caps:

• Unlimited swipes with no daily or weekly limit
• Unlimited matches and full in-app messaging
• Nesty AI coaching (conversation starters, dating advice, profile tips)
• Video verification and safety features
• All core discovery and matching functionality

5.2 NestyPoints Token System

NestyPoints are optional in-app tokens used to unlock premium actions. You can earn them free or purchase them. Tokens never expire.

5.3 Token Purchases

Token pack purchases are processed securely through our payment provider. Purchased tokens are added to your balance immediately upon successful payment. Tokens have no expiry date.

Token purchases are non-refundable once added to your account balance, as they represent an immediately-delivered digital good. If you experience a payment error or unauthorised charge, contact [email protected] within 7 days of the transaction.

5.4 Ad Watching

Watching a 30-second ad is entirely voluntary and earns 2 NestyPoints per ad. We do not interrupt the core swiping or messaging experience with mandatory ads. Ad content is served by third-party ad networks subject to their own privacy policies. Ad watching may result in aggregate impression data being shared with the ad network (e.g. that an ad was viewed) but your personal profile or dating data is not shared with advertisers.

6. Nesty AI Companion

Nesty is MatchNest's AI companion designed to help you navigate the dating world with more confidence and authenticity. She's here to offer guidance, not make decisions for you.

6.1 AI Service Terms

Nesty provides dating advice, conversation suggestions, profile feedback, and emotional support based on her training. She uses machine learning to understand dating patterns and what tends to lead to meaningful connections.

However, Nesty's responses are AI-generated and should be treated as one perspective among many. She's designed to encourage authentic behavior and healthy dating practices-not to replace human judgment. Ultimately, the decisions in your dating life are yours to make.

We continuously improve Nesty based on user feedback and relationship outcomes, but we can't guarantee that following her advice will lead to specific results. Dating involves human complexity that no AI can fully predict.

6.2 AI Access & Fair Use

Nesty AI coaching is available to all users for free. There is no token cost for standard Nesty coaching interactions (conversation advice, icebreaker generation, profile tips). NestyPoints are spent on discrete premium actions (Super Likes, Boosts, etc.) - not on basic AI coaching sessions.

To protect service quality for all users, we apply fair-use rate limits on AI requests. Automated or excessive programmatic queries to Nesty may be throttled. Human users interacting normally with the app will not encounter these limits.

6.3 Nesty Conversation Helper (Conversation Rescue AI)

Nesty includes a feature called Conversation Rescue AI (also referred to as Nesty Conversation Helper) - an in-chat assistant that suggests replies to help you keep conversations meaningful and moving forward.

Explicit consent is required. Before Nesty can read any conversation, you will be shown a clear in-app prompt:

"Allow AI to read this chat to help you?"

Nesty will not access any chat content until you explicitly grant this permission. This consent is per-conversation and can be revoked at any time from your chat settings.

Scope of access. When you grant permission, Nesty reads only the last 10 messages in the conversation (messages from both you and the other person) to understand the current context. It does not access your full message history, earlier conversations, or any other chat outside the one you have actively enabled.

Suggestions are never sent automatically. Nesty generates reply suggestions (in Playful, Considered, or Direct tone) and displays them to you. A suggestion is only sent as a message if you explicitly tap it. Nothing is sent on your behalf without your deliberate action. You remain entirely in control of what you communicate.

Revoking access. You may withdraw Nesty's access to a conversation at any time. Once revoked, Nesty will not read any further messages in that chat. Previously read messages are not retained for AI processing beyond the session in which they were used to generate suggestions.

7. Privacy & Data Usage

Your privacy matters to us. We're committed to being transparent about what data we collect and how we use it to create better connections for you.

7.1 Data Collection

We collect information you provide directly (profile details, photos, messages), information generated by your use of the platform (swipe patterns, feature usage, conversation quality), and technical data (device information, IP address, app performance).

This data helps us improve our matching algorithms, personalize your experience, detect fake accounts and scammers, and comply with legal obligations. We never sell your personal data to advertisers or third parties.

7.2 Data Sharing

We share minimal data with third parties and only for specific purposes: service providers who help us operate (cloud hosting, payment processing, AI services), law enforcement when legally required, and in cases of business transfer (merger or acquisition).

Your profile information is visible to other MatchNest users as that's essential for a dating platform to function. However, you control your visibility settings and can limit what others see. For full details, see our Privacy Policy.

7.3 Third-Party Services

We use trusted third-party services for payment processing (Stripe), AI capabilities (Anthropic), and cloud infrastructure (AWS/Google Cloud). These partners are contractually bound to protect your data and can only use it for the specific services they provide to us.

8. Intellectual Property

MatchNest's brand, technology, and content are valuable assets that require protection to maintain the quality and trust of our platform.

8.1 Our Rights

MatchNest owns all content on our platform, including our logo, brand name, app design, matching algorithms, Nesty AI technology, and any text, graphics, or code we've created. This intellectual property is protected by trademark and copyright laws.

You may not copy, reproduce, distribute, or create derivative works from our content without explicit permission. This protects both our business interests and ensures users aren't deceived by fake MatchNest services.

8.2 User Content

You own the photos, text, and other content you create and upload to MatchNest. When you submit content, you grant us a license to use it as needed to provide our services-storing it on our servers, displaying it to other users, and backing it up for security.

By uploading content, you confirm that you have the rights to do so (for example, you took the photos yourself) and that the content doesn't violate anyone else's intellectual property or privacy rights.

9. Disclaimers & Limitations

We work hard to provide a quality service, but we need to be clear about the limits of our responsibility to ensure a fair relationship.

9.1 No Warranties

MatchNest is provided "as is" without guarantees of uninterrupted service. While we strive to keep the app running smoothly, we can't promise 100% uptime. Technical issues, maintenance, or force majeure events may occasionally cause service disruptions.

We don't control the behavior, accuracy, or intentions of other users. Their content and actions are their own responsibility, and while we have safety measures in place, we can't guarantee that every interaction will be positive or authentic.

9.2 Limitation of Liability

MatchNest's liability for any claims arising from your use of our services is limited to the amount you've paid us (if any) in the 12 months before the incident occurred. This is standard practice for online services and helps us maintain affordable access for everyone.

We're not liable for indirect damages (like emotional distress from a bad date), incidental damages, or consequential damages-even if we've been informed of the possibility of such damages.

9.3 User Interactions

While we verify user identities through optional selfie verification, we don't conduct comprehensive background checks on all users. Dating involves inherent risks, and we encourage you to take precautions: meet in public places, tell friends about your plans, and trust your instincts.

MatchNest is a platform that facilitates connections-we don't control what happens after you exchange contact information or meet in person. Your safety is your responsibility, and we provide safety tips and reporting tools to support you.

10. Termination

We want MatchNest to work for you. If it's not meeting your needs, we'll make it easy to leave-and we'll take action against those who harm our community.

10.1 Termination by You

You can delete your MatchNest account at any time through your account settings. This permanently removes your profile, photos, messages, and matches from our platform. This action cannot be undone, and we'll no longer process your data as outlined in our Privacy Policy.

If you have an active subscription, remember to cancel it separately to avoid future charges. Account deletion doesn't automatically cancel subscriptions.

10.2 Termination by Us

We may suspend or terminate accounts that violate these Terms, harm other users, or engage in illegal activity. Before terminating, we typically issue warnings for first-time minor violations, but serious violations (like harassment, scams, or illegal content) may result in immediate termination.

If your account is terminated for violations, you won't receive refunds for unused subscription time. We may also ban associated accounts if we detect circumvention attempts.

Repeated content moderation violations - whether photos or messages - may result in permanent account termination as described in Sections 4.4–4.7. Moderation audit logs are kept as evidence and are available to you via the appeal process.

11. Changes to Terms

As MatchNest evolves, these Terms may need to change. We'll keep you informed about significant updates.

We may modify these Terms at any time to reflect new features, legal requirements, or business changes. For material changes-such as new fees, different data practices, or modified liability limits-we'll notify you at least 30 days before the changes take effect.

Continued use of MatchNest after changes become effective constitutes your acceptance of the updated Terms. We encourage you to review this page periodically to stay informed about your rights and responsibilities.

12. Governing Law & Disputes

These Terms are governed by the laws of India, and disputes will be handled through binding arbitration.

Arbitration is a private process where disputes are resolved by an arbitrator (not a court judge). It's typically faster and less expensive than going to court. This means you agree to resolve most disputes through arbitration rather than in public courts.

You also agree to waive your right to participate in class action lawsuits or class-wide arbitration. If you have a dispute with MatchNest, you'll resolve it individually. This helps us keep legal costs manageable and pass savings on to users.

For small claims court matters or injunctive relief, you may bring claims in your local courts. We encourage you to contact [email protected] first to see if we can resolve your concern directly.
